Terms of Use for Commissions

By commissioning artwork from Christopher Buesch, you agree to the following terms:

1. Payment

  • A 50% non-refundable deposit is required upfront before work begins. The remaining 50% is due upon approval of the final low-resolution, watermarked artwork.

  • The final high-resolution artwork will only be delivered after the full payment is received.

2. Process and Revisions

  • I will provide:

    1. An initial sketch for approval.

    2. One work-in-progress (WIP) update during the creation process.

  • One revision is included at both the sketch and WIP stages. Additional revisions beyond these will incur extra charges based on the complexity of the changes.

  • Feedback Timeline: The client has up to 5 business days to provide feedback after each stage (sketch and WIP). If no response is received within this time, the artist may proceed with the project based on the current design.

3. Timeline

  • Commissions will typically be completed within one month after receiving the initial deposit. However, this timeline may vary depending on the complexity of the project and the number of revisions requested.

  • Rush commissions may be accommodated for an additional fee based on the requested timeline. This must be discussed and agreed upon before the project begins.

4. Usage Rights

  • The commissioned artwork is for personal use only, unless otherwise explicitly agreed upon in writing. This includes displaying the artwork online (with proper credit) or printing for personal use.

  • Commercial use (e.g., reselling, merchandising, or incorporating the artwork into commercial products) is not permitted unless an additional commercial usage license is purchased. Terms for commercial use must be discussed and agreed upon before the commission begins.

5. Delivery and File Responsibility

  • After the final payment is received, the client will receive the artwork in high-resolution (without watermarks) via a downloadable link or email.

  • File types and sizes will be agreed upon prior to delivery, based on the client’s needs.

  • Client Responsibility: I will store final artwork files for up to 6 months after delivery. It is the client’s responsibility to save, back up, and maintain their copies of the final files once they are received.

6. Refunds and Cancellations

  • The 50% upfront deposit is non-refundable once work has begun.

  • If the commission is canceled before work starts, a full refund is possible.

  • If for any reason I am unable to complete the commission, a refund of the portion of work not completed will be issued.

7. Confidentiality and NDAs

  • If a client requests a Non-Disclosure Agreement (NDA) for confidentiality, this must be discussed and agreed upon before the start of the commission. Additional fees may apply for projects requiring full confidentiality.

  • Without an NDA, I retain the right to display the artwork in my portfolio and use it for promotional purposes.

8. Artist Rights

  • As the artist, I retain the copyright to all commissioned artwork. This means I can use the artwork for my own portfolio, promotional purposes, and as part of my artistic body of work unless otherwise agreed upon.

  • I will not resell or reuse commissioned artwork for other clients.

9. Client Responsibilities

  • The client must provide clear and detailed information at the start of the project. Major changes requested after the initial stages (sketch or WIP) may require an additional fee.

  • Unused revisions included in the base price are non-refundable.
